Pittsburgh Tribune-Review: West Penn plans to appeal decision to dismiss antitrust lawsuit

West Penn Allegheny Health System filed notice in federal court Friday that it is appealing the dismissal of its antitrust lawsuit against the University of Pittsburgh Medical Center and Highmark Inc.

West Penn claimed in the lawsuit that UPMC and Highmark worked together to drive out and keep out each other's competitors in the hospital and health-insurance industries. U.S. District Judge Arthur Schwab dismissed the lawsuit in October saying that West Penn's claim "falls short on any plausible facts to support its bald allegations."

Dan Laurent, spokesman for West Penn, declined to discuss the details of the appeal West Penn plans to file with the 3rd U.S. Circuit Court of Appeals. He said the region's second-largest hospital system stands by the allegations it made against the region's largest hospital system and largest medical insurer.

"We stand by our complaint and think it's in the best interest of the community to pursue this civil action to the furthest extent of the law," Laurent said.
